TERMS AND CONDITIONS OF USE
The Tourism Yukon Photo Library is
a searchable collection of images that can be accessed through these Websites;
www.yukontraveltrade.com and www.writeyukon.com.
The following Terms and Conditions govern your use of the Tourism Yukon Photo
Library and form a legal agreement between you, your company, your employer or
other legal entity and the Department of Tourism and Culture, Government of Yukon.
You are required to read the Agreement and accept all of its provisions before
you may download any image from the Tourism Yukon Photo Library. By registering
on the Website, you confirm that you have read all of the Terms and Conditions
and that you agree with them. If you do not wish to be bound by the Agreement
kindly do not use the Tourism Yukon Photo Library.
A) Copyright in Images
All photographs in the Tourism Yukon Photo Library are the exclusive property
and copyright of Government of Yukon and contributing photographers.
1. What You Can Do with the Images
The images can be used for layout, comping or internal presentations if you have
registered and intend to reproduce the images for any of the allowed uses under
these Terms and Conditions. Upon completion of the User Form stating your intended
use of the images you will be given a User I.D. and Password if your intended
use complies with our Allowed Uses of Images as set out in Part B herein. Permission
to use the images will normally be given within one working day of your request.
2. What You Cannot Do with the Images
Anything else, except as noted in Section A.1 above. The images may not be copied
or reproduced in any manner whatsoever without the prior consent of the Government
of Yukon.
3. Unauthorized Use of the Images
Unless you have registered and received a User I.D. and Password, it is illegal
to copy or use all or any portion of any image whether by photographic means,
scanning or digital copying. It is illegal to incorporate all or any part of
any image into another image.
4. Liability for Unauthorized Use of Images
You agree that any unauthorized use, publication or transmission of any image
by you is an infringement of copyright and that you will be responsible for any
fees, damages and/or compensation arising therefrom.
B) Allowed Uses of Images
1. Tourism Yukon Photo Library images may be used to promote the Yukon Territory
as a travel destination through co-operative marketing and other means. This
includes use in tourism trade shows, travel trade brochures, tourism web-sites,
promotions, magazines, media articles and travel literature. The images may be
used for location scouting in video and film production. 2. The images may be
used in publications that foster and promote a Yukon identity or awareness.
3. The images may be used to support formal partnership programs with the Government
of Yukon. 4. Images may not be used in publications and other promotional materials
that are sold as a retail item . ( i.e. post cards , picture books , posters
, etc.)
C) All Other Uses
1. Requests from companies or individuals or other legal entities for images
to be used for the advertising of a product or service not directly related
to the Yukon tourism industry shall be referred to private sector sources.
2. If the private sector sources are unable to supply the required images and
the Government of Yukon considers the use to be in the interests of the Yukon’s
tourism industry the government may supply the images. This will be determined
on a case by case basis.
D) Credit lines
If the image is to be used in an editorial context or certain other media,
such as web-site use, where the publishing of credit lines is the norm, or
is a condition of the license for the image, Tourism Yukon will require the
use of the credit line, Government of Yukon photo/“name of photographer, if indicated”.
E) Model Releases
An image is deemed to have a model release only if the existence is specified in the information attached to the image.
